TERMS AND CONDITIONS GOVERNING THE RENTAL OF THE LOCKERS

1. Locker rental service hours are from 11:00 a.m. to 11:00 p.m. daily.

2. Please read and follow the steps as illustrated in the user guide when using the Locker(s) and maintain proper usage at all times. Please ensure that the locker door is closed and locked properly before leaving.

3. No rubbish should be left in or near the Lockers.

4. All Items deposited in the Locker(s) by the Renter are deposited entirely at the Renter’s own risk in all respects and neither Keysen Property Management Services Limited (the “Company”) nor the Registered Owner for the time being of the Premises in which the locker(s) is located (the “Owner”) shall be liable for any damage or loss caused to such Items whether by reason of the Company’s or the Owner’s negligence or otherwise howsoever.

5. The Company has the right to stop the Renter from opening the locker(s) when the Company deems it necessary in order to protect the interest of or prevent risk or loss to others.  The Company shall not be held liable for any damages resulting from such action.

6. The Locker(s) shall not at any time be used for:

(1) the storage of any explosives, fire arms, ammunition or other articles or materials which are inflammable, dangerous or of an offensive, obnoxious and/or corrosive nature; or

(2) the storage of any illegal or unlawful articles, or for any illegal purposes.

7. If the Company suspects that a Locker(s) contains any such article referred to in Term 6 above or is being used for illegal purposes, it may without notice to the Renter open the Locker(s).  If the inspection substantiates the Company’s suspicion, the Company shall have the right to terminate the hiring at any time without notice to the Renter.  If the renting is terminated in accordance with this Term, no fees paid shall be refunded and if the Company or third parties incur any damages on account of such circumstances, the Renter shall be solely liable for such damages whether or not the use in breach hereof was to the Renter’s knowledge.

8. The Renter shall be solely responsible for any and all loss or damage to the contents of the Locker(s) resulting from such Locker(s) being opened pursuant to Term 5 and 6 above and neither the Company nor the Owner shall be liable for the same in any way whatsoever.

9. The Renter is not allowed to assign, sublet or underlet the Locker(s) to any other person.

10. If the Renter has left the Items in the Locker(s) after 11:00 p.m. daily, the Locker(s) will be automatically locked.  If for such reason, please call our Customer Service Hotline at (852) 3520 2800 for assistance.  The Renter should present valid identity document and settle the overtime charge plus an administrative fee of HK$100 before collecting the items.

11. If the Renter forgets the password to the Locker(s), the Renter should report to our Customer Service Hotline at (852) 3520 2800.  The Renter should present valid identity document and provide proof of the items.  Upon being reasonably satisfied as to the veracity of such report, the Company shall arrange for the Renter’s Locker(s) to be opened and the contents retrieved.  The Renter should settle the overtime charge (if any) plus an administrative fee of HK$100 before collecting the items.  The Company shall not be responsible for any loss or damage upon opening of Locker(s) whether resulting from false reports or from any other causes whatsoever.  If the Renter fails to prove his/her identity, the Company reserves the right to dispose of the Items deposited in whatever way it deems fit and the Company shall not be liable to the Renter and any other person for any claims whatsoever in respect of such action.

12. If the Renter fails to claim and collect the items within the rental service hours, the Company may, without prior notice to the Renter, open the Locker(s) and remove the Items from the Locker(s).  The Company reserves the right to dispose of the Items deposited in whatever way it deems fit and the Company shall not be liable to the Renter and any other person for any claims whatsoever in respect of such action.

13. The Company shall not be liable to any delay or loss caused by mechanical breakdown.

14. The Company shall be entitled from time to time to add, delete or amend the provisions of these Terms and Conditions by notice posted at or near the Locker(s), and such addition, deletion or amendment shall be deemed to be conclusively binding on and accepted by the Renter with effect from the rental period commencing immediately after the posting of such notice.

15. The Chinese version of these Terms and Conditions is for reference only and if there is any conflict between the English and the Chinese version, the English version shall prevail.
